CONTRACT OFFER

• 1. TERMS AND DEFINITIONS:
  • 1.1. Website - Internet resource http://incense.com.ua/
  • 1.2. Site Visitor - an individual who entered the Site without the purpose of placing an Order.
  • 1.3. Site User - an individual, Site Visitor who accepts the terms of this Agreement and wishes to place an Order in the online store.
  • 1.4. Buyer - a User who has placed an Order in the online store.
  • 1.5. An online store is an automatic order collection system owned by the Seller and posted on the Site, in which the Buyer receives all the information available to the Seller about the Goods and in which the Buyer places an order for the purchase of the Goods by clicking the "Checkout" button, in accordance with all terms and conditions of the Site.
  • 1.6. Seller - Individual - Entrepreneur Skripchenko Denis Vladimirovich.
  • 1.7. Product - incense, incense sticks, accessories and other assortment presented on the Site.
  • 1.8. Order - a duly completed request of the Buyer for the purchase and delivery to the address specified by the Buyer of the Products selected on the Site.
• GENERAL PROVISIONS:
  • 2.1. This Agreement, posted on the Seller's official Website (http://incense.com.ua/), is a Public Offer and contains all the essential conditions for organizing the sale and purchase of goods remotely (i.e. through an online store).
  • 2.2. This agreement is a public offer, that is, its conditions, in accordance with Art. 633, 641 of the Civil Code of Ukraine, are the same for all Buyers.
  • 2.3. In accordance with Art. 642 of the Civil Code of Ukraine, the full and unconditional acceptance of the terms of this agreement, that is, the public offer of the online store, is the fact of placing an order by clicking on the Site (http://incense.com.ua/) on the link (button) "ORDER" and payment for the order in the amount of one hundred percent on the terms of this Agreement.
  • 2.4. By concluding this Agreement, the Buyer confirms that he is fully and fully familiar with and agrees with all of its terms. The buyer, who is an individual, gives permission to process his personal data in order to be able to fulfill the terms of this Agreement, to make mutual settlements, as well as to receive invoices, acts and other documents. The permission to process personal data is valid for the entire term of the Agreement. In addition, by concluding this Agreement, the Buyer confirms that he is aware (without additional notice) of the rights established by the Law of Ukraine "On the Protection of Personal Data", of the purposes of data collection. The scope of the Buyer's rights as a subject of personal data in accordance with the Law of Ukraine "On the Protection of Personal Data" is known and understood by him.
  • 2.5. Changes cannot be made after the Buyer accepts the Offer in the manner provided for in the Offer.
• 3. SUBJECT OF THE CONTRACT:
  • 3.1. The Seller undertakes, on the terms and in the manner determined by this Agreement, to transfer the Goods to the ownership of the Buyer on the basis of the Order placed by ordering in the online store or in another way, and the Buyer undertakes to accept the Goods and pay for its cost.
  • 3.2.This Agreement governs the relationship of purchase and sale in the online store, including:
    • 3.2.1. Voluntary choice by the Buyer of the Goods in the online store;
    • 3.2.2. Self-registration by the Buyer of the Order in the online store;
    • 3.2.3. Payment by the Buyer for the Order placed in the online store;
    • 3.2.4. Execution and transfer of the Order to the Buyer in ownership under the terms of this Agreement.
  • 3.3. The Seller guarantees that the Goods are not pledged, are not in dispute, under arrest and are not subject to the rights of third parties.
  • 3.4. The Buyer accepts the terms of this Agreement at the time of placing the Order by clicking on the link (button) "PLACE AN ORDER" on the Site or in another way, which means confirmation by the Buyer of the fact of familiarization with the text of this Agreement and acceptance of its terms. The presence of any objections by the Buyer regarding the provision of his consent releases the Seller from any liability for failure to comply with the terms of this offer and gives the Seller the right to cancel the Order unilaterally.
• 4. REGISTRATION ON THE SITE AND THE ORDER PROCEDURE
  • 4.1. Registration on the Site is not mandatory for ordering.
  • 4.2. Registration on the Site is carried out using the "Registration" section of the "Personal Account" section, if the registration option is not available on the site, then registration occurs automatically at the time of ordering and with the buyer indicating his data.
  • 4.3. The Seller is not responsible for the accuracy and correctness of the information provided by the User during registration.
  • 4.4. The User undertakes not to disclose to third parties the login and password specified by the User during registration. If the User has any suspicions about the security of his login and password or the possibility of their unauthorized use by third parties, the User undertakes to immediately notify the Seller of this by sending an e-mail to incense.ua@gmail.com.
  • 4.5. The Buyer independently places an Order in the online store by adding the selected Products to the "Cart" by pressing the "ADD TO CART" button or by calling the phones indicated on the Site.
  • 4.6. Both registered Buyers and those that have not been registered, including those who place an order by phone, which is indicated on the Site, can place an Order for the Goods.
  • 4.7. The Seller has the right to refuse the User to place an Order if he has reason to believe that the User has indicated inaccurate data, as well as under the condition of unfair behavior (for example, violation of the terms of this Agreement).
• 5. PRICE OF THE CONTRACT AND PROCEDURE OF PAYMENT
  • 5.1. The price of the Agreement is equal to the amount of the Order. The amount of the order may vary depending on the value, quantity, or nomenclature of the Goods.
  • 5.2. The cost of each individual Product is determined by the Seller and is indicated on the Site.
  • 5.3. The cost of the Order is determined by adding the cost of all the Goods included in the Order and does not include the cost of delivery of the Goods to the Buyer.
  • 5.4. The Buyer makes payment for the Goods according to the Order. The buyer independently chooses one of these payment methods: using payment bank cards (Liq Pay), or payment to a Privatbank card using the details.
  • 5.5. Payment is made in the national currency of Ukraine - hryvnia.
  • 5.6. The order is considered paid from the moment payment is received on the Seller's bank account. The fact of payment for the Order indicates the Buyer's agreement with the terms of this Agreement.
  • 5.7. The cost of the Goods indicated on the Site can be changed by the Seller unilaterally. In this case, the cost of the Goods ordered by the Buyer is not subject to change.
• 6. TERMS OF DELIVERY OF THE GOODS
  • 6.1. Delivery is carried out using the services of the NOVAYA POCHTA company. The procedure for receiving the Goods is indicated on the official websites of the NOVAYA POCHTA company. The conditions for receiving the goods by self-pickup are negotiated with the Seller separately.
  • 6.2. The total delivery time of the Order consists of the order processing time and the delivery time.
  • 6.3. The processing time for an Order is one to three working days. The Seller cannot guarantee the availability of the Goods in the quantity specified at the time of placing the Order, as a result of which the processing time of the Order may increase.

  • 6.5 Payment for delivery is made by the buyer upon receipt, or in another convenient way with the company delivering the goods.
  • 6.6 The cost of payment for delivery is calculated individually when issuing a TTN for new mail. The cost of delivery depends on the size, weight of the parcel, as well as the distance of its delivery. The delivery cost includes additional services: box, filler, packaging; if the goods are picked up by a courier from the store, payment for additional courier services is paid by the buyer.
    
• 7. TERMS AND PROCEDURE FOR RETURNING GOODS

• 8. RIGHTS AND OBLIGATIONS OF THE PARTIES
  • 8.1.The seller is obliged:
    • 8.1.1. Comply with the terms of this Agreement;
    • 8.1.2. Fulfill the Buyer's Orders in case of receipt of Payment from the Buyer;
    • 8.1.3. Transfer the Goods to the Buyer, according to the selected sample on the Seller's Website, by placing an Order and the terms of this Agreement.
  • 8.2.The seller has the right:
    • 8.2.1. Unilaterally suspend the provision of services under this Agreement if the Buyer violates the terms of this Agreement;
    • 8.2.2. Other rights in accordance with the current legislation of Ukraine and this Agreement.
  • 8.3.The buyer is obliged:
    • 8.3.1. Comply with the terms of this Agreement;
    • 8.3.2. Get acquainted with the information about the Goods posted on the Seller's Website;
    • 8.3.3. Pay and receive the Order on time under the terms of this Agreement;
    • 8.3.4. Upon receipt of the Goods from the person who delivered them, ensure the integrity and completeness of the Goods by inspecting the contents of the package.
  • 8.4.The buyer has the right:
    • 8.4.1. Place an order on the corresponding page of the Seller's Site;

• 9. RESPONSIBILITY OF THE PARTIES AND DISPUTE RESOLUTION PROCEDURE
  • 9.1. The parties are responsible for non-fulfillment or improper fulfillment of the terms of this Agreement in the manner prescribed by this Agreement and the current legislation of Ukraine.
  • 9.2. The Seller is not responsible for damage caused to the Buyer as a result of improper use of the Goods purchased on the Website of the Online Store.
  • 9.3. The Seller is not responsible for the improper, untimely execution of Orders and their obligations in the event that the Buyer provides inaccurate or false information.
  • 9.4. The Seller and the Buyer are responsible for failure to fulfill their obligations in accordance with the current legislation of Ukraine.
  • 9.5. The Seller or the Buyer are exempt from liability for full or partial failure to fulfill their obligations if the failure is the result of such insurmountable circumstances as: war or military action, earthquake, flood, fire and other natural disasters, acts or actions of state authorities, changes in customs regulations, restrictions import and export that arose regardless of the will of the Seller and / or Buyer after the conclusion of this Agreement. The Party that cannot fulfill its obligations immediately notifies the other Party about it and provides documents confirming the existence of such circumstances, issued by the authorized bodies.
  • 9.6. All disputes under this Agreement are resolved through negotiations. If no agreement has been reached, disputes are resolved in court in accordance with the current legislation of Ukraine.
• 10. DURATION OF THE CONTRACT
  • 10.1. This agreement comes into force from the day the Order is placed and is valid until all the terms of the Agreement are fulfilled.
• 11. OTHER CONDITIONS
  • 11.1. The Agreement concluded in accordance with this Offer is considered concluded on the territory of Ukraine and operates within the framework of the legislation of Ukraine.
  • 11.2. The invalidity of any clause or part of the Agreement concluded in accordance with this Offer does not lead to the invalidity of the Agreement as a whole.
  • 11.3. In the event of any claims, the Buyer must contact the Seller's representative by phone or e-mail indicated on the Site.
  • 11.4. The site contains materials, trademarks, trade names and other materials that are protected by law, including, but not limited to, texts, photographs, graphics, music and sound works.
  • 11.5. All content of the Site is protected by the Legislation of Ukraine.
  • 11.6. Visitors, Users and Buyers are not allowed to use the materials posted on the Site, such as: make changes, publish, transfer to third parties, participate in the sale or assignment, create derivative products, etc.
  • 11.7 The online store and the services provided may be temporarily partially or completely unavailable due to maintenance or other work or for any other technical reasons.   • 11.8 Privacy Policy is an integral part of this Agreement. It is posted on the Seller's Website.
  • 11.9 Completion of the registration procedure or placing an order without registration means the unconditional consent of the Site Visitor to the conditions for processing the personal information of the Site User specified in the Privacy Policy; in case of disagreement with these conditions, the Site Visitor must refrain from using the Site.

The User / Buyer has the right to refuse to receive advertising and other information without explaining the reasons for the refusal. Service messages informing the User / Buyer about the order and the stages of its processing are sent automatically and cannot be rejected by the User / Buyer.
• 6. The seller has the right to use the "Cookies" technology. "Cookies" do not contain confidential information and are not transferred to third parties.
• 7. The seller receives information about the ip-address of the website visitor (http://incense.com.ua/). This information is not used to identify the visitor.
• 8. The Seller is not responsible for the information provided by the User / Buyer on the Site in a public form.
• 9. The Seller has the right to record telephone conversations with the User / Buyer. At the same time, the Seller undertakes: to prevent attempts of unauthorized access to information received during telephone conversations and / or its transfer to third parties not directly related to the execution of Orders, in accordance with the Law of Ukraine dated 02.10.1992 No. 2657-XII "On information ".
